WAIVER/ RELEASE OF LIABILITY, PRE-DEPARTURE FORM

All participants of our trips are required to read and sign our Waiver/ Release of Liability/Pre-departure Form (paper form) before trip departure. 

BOOKING POLICIES:

The trip deposit (30% of trip cost) should be paid while booking the trip. Upon receiving it we put your booking on confirmed booking list and start your trip preparation. This advanced deposit is non-refundable however its fully transferable ( you may transfer it to another trip) or place this deposit for your next trip before the time of your final trip payment.

FINAL PAYMENT:

The payment (full balance) should be settled before your trip departure date.

ACCEPTANCE & BOOKING PROCIDURES:

Upon receiving your booking request (via e-mail or online form depending on the trip and chosen way of correspondence)  we will notify you that we received it. And we will guide you for next booking steps.  A trip booking is not confirmed until we have received advanced deposit payment or full payment (depending on a trip you are booking) and your completed registration. 

Once we receive it from you we put your booking into confirmed booking list, inform you about it vis e-mail. A binding contract will come into existence between Trail Himalayas Pvt. Ltd. and you as soon as we have sent you a booking confirmation via e-mail confirming the details of your  booking.

IMPORTANT INFORMATION :

  • Its a rider’s responsibility to read and understand all information regarding biking trip on our website, to  ask us any questions or request additional information via methods of communication published on our official website.
  • To chose trip suitable for riders biking skills level and previous biking experience. If have any concerns and doubts to discuss it with us prior to a trip booking via ways of communication published on our website.
  • Its a rider’s responsibility to follow terms and conditions stated in this document as well as provided  by us in trip booking process.
  • To acknowledge the nature of an activity and what it involves.
  • To provide us information (while booking the trip) on personal health condition, any health issues or other personal matters which may influence well-being on the trip and may compromise in any way successful trip completion.
  • To provide us information (while booking the trip) on food restrictions, allergies or medical diets prescribed by your doctor. We do our best to accommodate it during the trip in all possible for us ways if information is provided in advance (while booking the trip) or we will advise and recommend what is good to bring with you to Nepal to make your trip more comfortable. 
  • To provide us information (while booking the trip) on any medications currently taken and anything prescribed by your doctor & to bring needed amount of it with you to be enough for your trip duration 
  • Its riders solely responsibility to consult with a medical professional / physician back home prior to booking the trip and to make sure that you are in good physical condition & health and able to conduct chosen trip & difficulty level in a safe manner.

TRAVEL and MEDICAL INSURANCE:

We highly recommend you to play it safe and to obtain medical insurance back home while planning your trip to Nepal understanding the remoteness of areas and elevation where the trip taking place, covering adventure activity you going to undertake and including remote evacuation, helicopter rescue/evacuation, etc  from elevation to which your trip goes. 

If you chose to travel without adequate medical insurance you take full responsibilities of any and all expenses which may arise in case of injury, sickness, illness, emergency situation, cover evacuation cost, hospitals, medical treatments etc…  

Trail Himalayas Pvt. Ltd. is not holding any liability or responsibility for any expenses which may arise in any such cases

We suggest our participants to have Travel Insurance  to avoid loss of funds in case if cancellation is necessary.  Trail Himalayas Pvt. Ltd. is not liable of any loses or expenses.

TRIP CANCELATION FROM YOUR SIDE:

The trip advanced deposit (30% of trip cost) is non-refundable however its fully transferable ( you may transfer it to another trip, valid for one year)  if you decide to cancel your trip not later than one month prior to trip departure. 

Later dates cancelations are  considered as last moment cancelations. Last moment cancelations are non-refundable and non transferable. 

If you decide to cancel your trip very last moment or after full payment is settled: 30% of the trip cost is non-refundable and non transferable, in addition to it any and all expenses which come with your trip cancelation and any and all costs of arrangements which already done by us for your trip are non-refundable.

CANCELATION FROM OUR SIDE:

Travel Himalayas Pvt. Ltd. reserves the right to cancel or modify/change tour plan at any time. If such case arises the full amount of payments (only for services which were not provided) received by Trail Himalayas Pvt. Ltd. should be returned or transferred for another trip if agreed from both sides. Please note that once the trip is confirmed by us cancellations from our side are extremely rare.

DISASTERS , POLITICAL INSTABILITY OR OTHER LIMITING CIRCUMSTANCES / EVENTS:

Natural disasters  including but not limited to landslides, earth quicks, flooding etc 

Political  unrest or other events which may influence travel etc… Such things are hardly predicted however we are ready to do our best in such cases and whenever possible Travel Himalayas Pvt. Ltd. will inform the participants. If the trip is postponed, cancelled or tour plan is modified for the group/s safety in case of natural disaster or political unrest Trail Himalayas Pvt. Ltd. will not be responsible  for any lose of funds or additional expenses.

We recommend all riders to obtain Travel Insurance  back home while planning the trip.

ADVENTURE TRIPS & FLEXIBILITY, TRIP PLAN  CHANGES/MODIFICATIONS:

Biking is an adventure activity and rider should understand  that the nature of this activity  requires flexibility. We do our best to stick to the trip plan and itinerary however  its understood that the distance, timing, route, amenities and transport maybe subject to alteration due to unforeseeable circumstances, events or situations which are out of our hands to handle. We will explain and discuss the changes and talk about reasons behind in case such situation take place

PASSPORT, TRAVEL DOCUMENTS:

Participants are solely responsible  for ensuring travel documents are valid for traveling to Nepal (min 6 months past the date of the trip).

HEALTH AND FITNESS REQUIREMENTS:

Participants should be fit, active, in good health and physical condition to undertake the trip and understand well before booking the trip biking skill level requirement for the trip. 

For our destinations (multi-days biking trips) participants should be able and to be comfortable riding at a relaxed pace for up to 3-4 hour + per day for multiple days. Have stamina and be able to bike/ walk the bike uphill.  Participants should consult medical professional /physician back home prior to booking the trip with us to make sure that physical and health state is matching level of the trip. 

BIKING SKILLS LEVEL:

Participants should read and understand well biking skill level requirement for the trip planning to undertake. Biking skills level requirements information is provided for each trip on our website. If have any additional questions – please contact us via published ways for communication on our website prior to booking the trip.

We do our best to match riders skill level and physical ability when booking a trip with us. In case the rider does not have skill level or have any condition compromising ability to conduct the trip we look for solution such as hiring another guide when possible  or changing tour plan, skip some riding parts and hike, hire porter, use transportation if possible, etc. Rider is solely responsible for covering any and all expenses involved in adjusting the trip to riders needs during the trip.  

YOUR BIKE & RENTAL BIKES:

Participants are responsible to bring a suitable bike ( bike requirements are provided by us while trip booking) and they assume full responsibility of its condition and maintenance prior and during the trip. Riders must perform daily bike checks and immediately inform the Guide of any concerns or mechanical issues or if need any assistance with the bike any time.

Riders are also responsible for having appropriate parts and tools needed to unsure bikes are in good running condition.  If you need to rent a bike in Nepal please inform us in advance while booking your trip with us. Rides hold full responsibility of the condition, maintenance,  damage or lose of the rented bike or any other equipment prior and during the trip and hold full responsibility to cover any and all expenses in case of lose or damage of rented bikes or any other equipment. Its riders responsibility to unpack, build the bike prior to the trip and to service and pack the bike after the trip. To care about the bike is your responsibility on our trips but our guides are skillful mechanics and bike lovers and always here to assist you with any bike matter  or to recommend you bike workshop. 

LOSS and DAMAGE:

Trail Himalayas Pvt. Ltd. is not responsible and we do not hold any liability for any lose, damage, etc of any personal belongings, bikes and any rented equipment (bike etc.) Participants are solely responsible for looking after all personal belongings and all and any rental equipments at all times.

SINGLE ROOM SUPPLEMENT DURING THE TRIP:

Single room supplement is extra cost. If you like to have single accommodation in the cities or during the trip (if and where its possible to arrange) please inform us in advance while booking the trip . The amount varies for each trip depending on accommodation standard and destination. We will send you additional cost details for since supplement and do arrangements accordingly after agreement & confirmation.

In general in all our trips sharing accommodation is included.

SPECIAL INTEREST & PRIVATE TRIPS, EXPEDITIONS:

Our trips and services are not limited to only tours published on our website.

If you are looking for a trip not listed on our website – contact us via published communication ways to discuss details.

 If you want to do published tour but have concerns or want to change parts of it (substitute accommodation type, mode of transport, biking days, hire additional support, etc) – contact us and we plan the trip according to your interests, quote your trip cost and procedures to book it.

ERRORS & OMISSIONS:

Occasionally some writing mistakes, information that contains errors on our website or any published means, some  omissions that may be connected with general descriptions, tours details, availability etc may occur. We reserve full right to correct, change any inaccuracies or update any information at any time without prior notice.

CHANGES TO TERMS & CONDITIONS:

You can review the most current version with latest changes at any time on this page.
When booking a trip with us version of terms & conditions will apply which was published and active at the time of booking.

 If any essential changes to conduct the trip occur on a later date and before or during your trip – we will inform you about.
